Lil Mosey admits having consensual sex with complainant accusing him of rape

The rapper has pleaded not guilty to second-degree rape and would like evidence of his previous relationship with the accuser presented at trial.

Lil Mosey hasn’t been in the spotlight much in 2021, and maybe that’s because the rapper has had to deal with some serious allegations. Last April, he was charged with second-degree rape after a woman told authorities that he, along with his co-accused Francisco Prater, 19, had sex with her “when she was not not able to consent due to physical impotence or mental incapacity, ” according to court documents. Following the preliminary investigation and hearings, the rapper pleaded not guilty and was reportedly ordered to stay away from the alleged victim.

But his college of lawyers submitted new legal documents further detailing Mosey’s relationship with the plaintiff.

According to TMZ, Mosey claims he and the accuser have had consensual sex in the past and is asking the court to allow this information to be released during his trial. The documents also indicate that Mosey and the alleged victim first met at one of his concerts and then entered into a predominantly sexual relationship.

Lil Mosey claims they had sex at a New Years party and then again in a car. He claims the second time was on the same night as the alleged rape, which she said later occurred in a cabin.

The case is on trial in Washington, and the state has an anti-violence shield law that generally prohibits evidence of prior sexual relations and activity with an alleged victim at trial.

TMZ also reports that Mosey’s legal team wants the alleged prior relationship included in the lawsuit “because he thinks it helps him defend against the allegation of non-consent.” However, prosecutors would not see how a prior consensual relationship could override the consent that was lacking in the incident in question.
